Terms & Conditions (updated 01/05/2008):

·         Required documents to be attached to the goods:  copy commercial invoice, copy packing list.

o    * Originals of above documents translated into Arabic language and legalized by Libyan consulate abroad, must be presented by the Consignee upon final customs clearance at Libyan customs authorities in port customs bonded warehouse. This is usually send by express courier from Supplier to Consignee. We do not need originals.

·         Chargeable Weight  (CW) ratio: 1 m3 = 333 kgs CW (for stackable goods)  or 1 loading meter = 1850 kgs CW (for  non stackable goods)

·         1 loading meter equals to occupied space inside truck/container with following dimensions: L1.00 x W2.35 x H2.35 m.

·         Goods transported by truck are subject to limited liability of the carrier as per Geneva CMR convention. The max responsibility of the carrier is fixed as 8.33 Dts / per kg of gross weight of the goods.

·         Rates valid for none hazardous, none oversize materials.

·         The charges are based on the actual costs

·         Any packages exceeding following max dimensions and gross weight must be reconfirmed with us:   L3.00 x W2.35 x H2.35 m  / 2 tons per package

·         Any customs authorities in the countries of export – transit –import have the right to inspect the content of the packages. In such event the packages might be opened.

·         All rates in EUR.  

·         Collection costs from EXW Supplier warehouse to M&M warehouse can be calculated upon providing us Supplier’s location Post Code.

·         Rates do not include any charges payable in Libya. Please see below table for estimation of local charges payable in Libya.

·         In case of high congestion, bad weather or other conditions preventing to discharge at Tripoli port – we reserve the right to use alternative port of discharge.

·         Shipper must confirm readiness for collection and provide export documentation at least 2 working days before dispatch.

·         All Libyan receivers are advised to inspect their goods before signing warehouse receipt from Tripoli/Misurata port warehouse. In case of any damages, missing items or any problems with goods, receiver must inform immediately to our agent Tegerhy who shall send their representative to the port warehouse in order to make survey report which must be signed by Libyan Customer, Tegerhy and Port Warehouse. Otherwise it will be quite difficult to raise a claim for the goods insurance.

·         We strongly recommend to insure your goods with “ad-valorem” insurance if you have high value commodity. Please note that “ad-valorem” insurance for goods is covering responsibility from the moment of loading of collecting the goods from Supplier till the moment goods are discharged to the customs bonded warehouse in Libya.

·         Departures/routings/transit times may change depending on official bank holidays, vessel schedule delays, port congestions, etc... We kindly request you to reconfirm with us about dispatch of the current week.

·         Payment options:

o    Freight prepaid: The freight must be paid by EU Exporter to M&M

o    Freight payment by int’l bank transfer to M&M France account. Shipment will be released after confirmation of payment receipt.

·         Some goods are restricted and/or prohibited for import to Libya. Preferably to check goods descriptions prior shipment, with relevant Libyan authorities.
